Instaclass Tech FZCO (Instaclass) is promising to be a leading regional educational platform that provides innovative and secured solutions to both tutors and learners.

Instaclass is aspired and strongly positioned to quickly move from being a regional platform into being of the top international Education Technology providers and platforms, and therefore, we would like all interested tutors/teachers who join our family, to read and agree on the below terms, which are designed to insure that we all do our best in this journey to become one of the smartest, most efficient, most professional and top quality platform globally.

  1. Genuine certificates and details:

  1. All the papers, certificates, diplomas, university degrees or any other documentation provided by teachers registering and applying to work within InstaClass Website must be true and legal. Any person attempting to mislead or to provide the company with fraud documentation will force the company’s administration to take legal actions against that person.

  1. All personal details like name and age must be accurate. Teachers providing the company with wrong information about themselves will force the company’s administration to ban them from working on InstaClass’s website and app and their account will be automatically deactivated.

  1. All teachers registered on Instaclass website should state in case they had any previous criminal history, misdemeanor, or felony of any kind.

  1. Work rules and regulations

  1. Instaclass is an online platform and technology provider, and as such, all of tutors and teachers registered on our platform are approved based on free lancing basis and they are not employees of Instaclass.

  2. Tutors, teachers, trainers and all other part time/free-lance staff carry the responsibility of insuring that their work and services tendered through Instaclass does not contradict, breach or impact by any possible way their contractual and legal duties to their existing employer, nor the applicable Labor law in their country of residence. Instaclass will not hold any responsibility that results from none compliance with the above condition.

  3. Tutors, teachers and trainers are hired on free-lance/commission basis, and they will be entitled to receive commissions at a pre-agreed rate for the number of sessions they conduct through Instaclass, and Instaclass will not be responsible for any payment of salary or employment benefits to any of the teachers, tutors and trainers beyond their share of the sessions commessions

  4. Tutors, Teachers and trainers will be acting as free-lance affiliate of Instaclass; any publicity materials should make it clear that you are a free-lance user within InstaClass’s platform and that you are not an employee of InstaClass unless there were other written agreements between you and the company and approved by both sides.

  5. Teaching courses or sessions involves teaching the curriculum / lesson to learners, but not to provide any form of teacher training for adults (i.e. training others to teach the course, lesson, or curriculum).

  6. Tutors, Teachers and trainers must always adhere to Instaclass dress code while conducting the sessions/classes.

  7. Any form of verbal or cyber abuse whether through the online platform or through any channel of communication to any of the students or other teachers / staff within InstaClass will be dealt with in extreme seriousness and according to the international law of Cybercrime and the “Global Cyber Law Database (GCLD)”.

  8. Tutors and teachers are not allowed to ask for any separate payment, contact details personal info, religious or ethnic background info from the learners/students

  9. Tutors are entitled to demand or collect their income share of the sessions conducted by them only when they complete a certain agreed number of days or sessions by the teacher/tutor, only then, InstaClass administration will arrange to transfer the due amount to the teachers/tutor’s account/name.

  10. Disputes or arguments between Tutors, teachers and learners/students outside the scope of the learning topic during the session (i.e. political debates, unethical topics, racist arguments, and all kind of debates that are considered controversial) are not allowed, such offences may result in financial and legal actions against all parties involved.

  11. Tutors must be punctual in case they accept a sessions request from a learner, not show up delay is not tolerated whatsoever as the tutoring sessions would be paid by the learner upon booking. Instaclass reserves the right to impose the appropriate penalty on delayed /unpunctual tutors that is typically a deduction of one standard session commission from his/her pay.

  12. During your work as a tutor / trainer through InstaClass online platform you agree that you will not upload, post, or otherwise distribute or facilitate distribution of any content—including text, communications, software, images, sounds, data, or other information—that:

  1. could be harmful to minors;

  2. is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, contains explicit or graphic descriptions or accounts of sexual acts (including but not limited to sexual language of a violent or threatening nature directed at another individual or group of individuals), uses vulgar language in the creation of a username or password, or otherwise violates our policies or these Terms;

  3. is contrary to any legal requirements, social requirements, and content regulations (including but not limited to customs, religious and other cultural sensitivities) of the UAE.

  4. victimizes, harasses, degrades, or intimidates an individual or group of individuals based on religion, gender, sexual orientation, race, ethnicity, age, or disability;

  5. infringes on any patent, trademark, trade secret, copyright, right of publicity, or other intellectual or proprietary right of any party;

  6. constitutes an unauthorized commercial use such as, but not limited to, engaging in unsolicited advertising, junk, or bulk e-mail (also known as “spamming”), chain letters, any other form of unauthorized solicitation, solicits passwords or personally identifiable information, or any form of lottery or gambling, sweepstakes or advertising or political campaigning;

  7. disrupts the normal flow of dialogue, cause a screen to “scroll” faster than other users of the Services are able to type, or otherwise act in a manner that negatively affects other users’ ability to engage in real time exchanges;

  8. interferes with or disrupts the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies, or regulations of networks connected to the Services;

  9. stalks” or otherwise harasses another;

  10. contains software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of any third party;

  11. impersonates any person or entity, including any employee or representative of Pansophic Learning or one of its affiliates or otherwise misrepresents your affiliation with a person or entity. You also agree that you will not harvest or collect information about the users or Members of this Site or use such information for the purpose of transmitting or facilitating transmission of unsolicited bulk electronic e-mail or communications;

  12. constitutes, encourages or provides instructions for a criminal offense, violates the rights of any party, or that would otherwise create liability or violate any applicable laws, enactments, decrees, orders (having the force of law), government acts, regulations, regulatory policies and guidelines, industry codes, regulatory permits and licences which are in force in the UAE or underinternational law; or

  13. includes private information of any third party, including, without limitation, addresses, phone numbers, email addresses, Social Security numbers and credit card numbers.

  1. Dress and conduct code:

  1. Tutors, teachers and trainers must wear an appropriate formal shirt or smart T-shirt during the entire tenure of the session/class,

  2. Tutors, teachers and trainers must insure that they are conducting the sessions/classes from a quite area with no disturbing or side sounds/noise at all times.

  3. Tutors, teachers and trainers must insure that there are no distracting, provocative or offensive items visible in the background while conducting the sessions/classes including religious symbols.

  4. Failing to adhere strictly to the above codes will result in terminating the relevant Tutors, teachers or trainers affiliation and services with Instaclass, and inflicting an appropriate penalty that includes pay deductions.

  1. General:

    1. By registering on InstaClass you undertake that the provided copies of your academic qualifications, experience certificate and other required personal and professional data are true, authenticated and genuine.

    2. You are required to provide a profile photo, and a self captured video shooting of yourself reciting a pre-determined text to be provided to you by Instaclass. completing your registration process is in fact an approval that your Video shooting and photo will be administered by our IT team and included in the tutors database.

    3. You are not allowed to publish, distribute or acquire any photo or video session including any individual (students or other tutors) on InstaClass website without their written permission and the written approval of the company’s administration.

    4. You may not link InstaClass website to any other external site resources or documents or use a third party provider or software without the permission and approval of InstaClass company administration.

    5. Plagiarism is strictly prohibited on InstaClass platform or any related applications or in any correspondence with any of InstaClass community (Tutors and Students).

  1. Payment entitlement:

  1. Instaclass has constructed a combined list of pre-defined rates for all of the sessions conducted through its platform which might vary according to: (1) Time of the school year. (2) subject and (3) Curriculum/language. Such rates per sessions are unified for all tutors for the same subject, curriculum and language.

  2. Tutors are eligible to a pre-defined income share of the fees for all the sessions conducted by them, subject that those sessions are conducted as per the protocol defined by Instaclass, therefore, the income sharing and payment to Tutors and Teachers eligibility will be first confirmed by the Instaclass Education Supervisor after reviewing the sessions and insuring full compliance with the sessions protocols mentioned in section 6. Failure to comply with sessions protocol will result in cancellation of the tutor/teacher’s entitlement of the session’s income share and may also result in termination of the tutor’s/teacher’s registration on the platform in case repeated.

  3. The pre-defined income share between Instaclass and the Tutor is 40 % to 60%, so Instaclass will charge 40% of each session’s income and pay 60% to the tutor who conducted the session, Instaclass will use its share of the income i.e. 40% partially to cover the following expenses: (1) The ongoing development of the application and Website to maintain our cutting edge technology and remain one of the top educational platforms in the region. (2) The ongoing maintenance work of the application and Website to insure smooth operations and problem fixing. (3) The media and advertising costs in order to attract more and more learners to Instaclass Platform, so registered Tutors receive more traffic. (4) Salaries and costs of the Educational Supervisor and other staff required to insure that our operations are conducted according to the top international standards. (5) The costs of video conferencing provider. (6) Paying the costs of collecting the fees from learners from around the world through third party payment gateway, and sending payments to all tutors in different countries. (7) other administrative costs related to the operations of Instaclass, in addition to the research and development costs to keep moving our platform to the next stages. The income sharing split is subject to change by Instaclass which will be communicated ahead to all Tutors

  4. The above mentioned Income share agreement is also applicable in the case of Group classes, hence, tutors who conduct sessions for more than one learner will earn 60% of the total fees paid by all learners.

  5. Tutors/teachers are entitled to receive their due payments every month (at the beginning of each month) provided that they had given one or more session(s) in the previous month and instaclass will bear the transfer charges in such cases except in the following two cases:

    1. In case the Tutor has not completed a minimum of 10 classes in 30 days, then the payments for their sessions will be done at the tutor’s expenses and Instaclass will not bear the transfer charges.

    2. When transferring charges exceed USD 8/-, then receivers will have to bear any transferring costs above the USD 8/-, however in the case where the tutor wishes to receive his/her entitled payment earlier to the aforesaid criteria has to submit a request for the approval of Instaclass and all transfer costs will be borne by the Tutor/teacher.

  6. Instaclass will transfer the tutors’ payments to their registered bank accounts details or in case of none availability of bank accounts, Instaclass will transfer the payments to the chosen exchange house, tutors/teachers are solely responsible of the integrity and accuracy of the payment details provided to Instaclass on the Tutor’s profile, and in case of any error in the payments details registration, tutor/teacher will bear the costs and time required to modify the payment.

  1. Sessions Protocol:

Tutors must meet the following requirements and guidelines in order to insure that their sessions meet Instaclassprotocols and become eligible for payment:

  1. Tutors must insure that they have the appropriate electronic devices required to perform their tasks, the approved Instaclass devices are Laptops (preferably with writing pad), IOS tablets, and Android Tablets. Mobile phones are not and approved device to conduct the sessions, while they can be used only to review and accept class and sessions request. In case tutors accept class/sessions requests without having the above mentioned technical requirements, Instaclass will have the right to cancel such classes/sessions even if already conducted by the tutors.

  2. Tutors must insure that they have an appropriate internet connections at all times with a minimum speed of 3 Mega Bytes per second.

  3. Tutors must check their Instaclass Website and or Instaclass application consistently to view the session requests received through the platform, and then accept the sessions suitable for the tutors’ time and experience.

  4. Tutors must insure that he/she has the required experience and qualifications to perform the accepted sessions, and in order to attract higher rating from the learner, learners will have the option of low rating the tutors in case of knowledge gaps and such low rating will result in reducing the tutors’ listing on Instaclass’s preferred tutors.

  5. Tutors must insure that they meet and comply with all the terms and conditions listed in this document, and failure to comply will result in cancelling the tutor’s entitled payment.

  6. After accepting a certain session, the tutor must insure logging into the session at least 5 minutes before the start time, and read the comments of the previous tutors and any pre-class comments from the learner in case available. Late show up will result in cancelling the tutor’s payment eligibility of the session.

  7. Tutors must start the sessions with an appropriate introduction of themselves to the learners, and then discuss any previous comments from other tutors or pre-class comments from the learners, and then make sure they use the full class time to deliver the best results required by the learners, tutors cannot end the class before the booked time unless specifically requested by the learners.

  8. After completing the session, Tutors must complete the Tutors’ Comments section for every session which must include: (1) Topics covered. (2) Learners knowledge level and gaps. (3) recommendations to learners toimprove their understanding of the topics. (4) recommendations to parents in case of school students.

  9. The sessions will be considered completed and eligible for payment until and unless the Tutor’s Comments Sections is filled and completed, the same will be reviewed by our Instaclass Education Advisor.

  10. Learners will have the option of rating the tutors after every sessions based on the Tutor’s appearance, level of knowledge, delivery and explanation method, language and accent. Such rating will be available to the public and will have very strong impact on the future requests coming from learners to the tutors according to their rating.

  11. Instaclass platform is also designed to give priority to the tutors according to their ratings when sending the class requests from learners.

This is the governing document of the relationship between Instaclass Tech FZCO and all tutors, teachers, and trainers registered on Instaclass platform, all points and items of this document are subject to changes and updates from Instaclass.
